Terms Of Use

Welcome to KabJunction. These Terms of Use (“Terms”) govern your access and use of our applications, websites, content, products, and services (collectively, the “Services”) provided by KabJunction, Junction Enterprises Private Limited, located at 2033, Fourth Floor, Sainik Colony, Faridabad.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

 

1. Contractual Relationship

1.1 These Terms create a legal agreement between you and KabJunction. They override any prior agreements.

1.2 KabJunction may terminate or suspend your access to the Services at any time, for any reason.

1.3 Supplemental terms may apply for certain promotions, events, or services. These terms will be provided at the time of use and will take precedence over these Terms if there is any conflict.

1.4 KabJunction may share necessary information, including your contact details, with claims processors or insurers to resolve complaints or disputes involving you and third-party providers (including drivers).

 

2. The Services

2.1 KabJunction provides a platform for booking cabs with independent third-party providers. Services are for personal, non-commercial use unless otherwise agreed in writing.

2.2 License:

  • You are granted a limited, non-transferable, non-exclusive license to access and use our Services and content on your personal device.
     

  • Any rights not explicitly granted remain with KabJunction.
     

2.3 Restrictions:
You may not:

  • Remove copyright or trademark notices
     

  • Reproduce, modify, or distribute Services content
     

  • Decompile or reverse engineer the platform
     

  • Scrape, mine, or overload the system
     

  • Access the system without authorization
     

2.4 Provision of Services:
Services may be provided by KabJunction’s affiliates or independent third-party providers with proper permits.

2.5 Third-Party Services and Content:

  • Some services or content may come from third parties. KabJunction does not control or endorse third-party offerings and is not liable for them.
     

2.6 Ownership:

  • KabJunction or its licensors own all rights to the Services and content.
     

  • You do not gain rights to KabJunction’s trademarks, logos, or intellectual property.
     

 

3. Your Use of the Services

3.1 User Accounts:

  • You must register an account and be at least 18 years old.
     

  • Provide accurate, up-to-date information.
     

  • You are responsible for all activity under your account.
     

3.2 Sales Partners:

  • Partners (affiliate, travel agent, API) generating business for KabJunction are subject to the same Terms and receive commissions accordingly.
     

3.3 User Conduct:

  • Services are not for minors under 18.
     

  • You may not transfer your account or authorize others to use it.
     

  • Use Services lawfully and as intended (e.g., no hazardous materials, follow route plans).
     

  • Smoking, alcohol, and narcotics are prohibited.
     

3.4 Vehicle and Service Specifications:

  • You cannot demand a specific car brand, model, or fuel type.
     

  • Seating and AC may vary by vehicle type.
     

  • KabJunction ensures compliance with applicable laws and safety standards.
     

  • Luggage limits and proof of identity may apply.
     

3.5 Non-Discrimination:

  • KabJunction does not discriminate against drivers or users based on religion, caste, gender, or age.
     

  • Cancellation or refund requests based on discrimination will not be entertained.
     

3.6 User Content:

  • You may submit feedback, reviews, or other content (“User Content”).
     

  • You retain ownership but grant KabJunction a perpetual, worldwide license to use, modify, and distribute it.
     

  • User Content must not be illegal, offensive, or infringing on third-party rights.
     

3.7 Network and Device Requirements:

  • You are responsible for data access, network fees, and device compatibility.
     

  • KabJunction does not guarantee functionality on all devices.
     

 

4. Payment

4.1 Charges:

  • You are responsible for all payments for services booked through KabJunction.
     

  • Payments facilitated by KabJunction on behalf of third-party providers are considered final.
     

  • Charges include applicable taxes and are generally non-refundable unless KabJunction decides otherwise.
     

4.2 Promotions & Discounts:

  • Promotional credits and discounts may be applied at KabJunction’s discretion.
     

  • Discounts may be canceled at any time.
     

4.3 Trip Modifications & Add-Ons:

  • Full trip payment is required even if you shorten your trip.
     

  • Extra charges apply for extended trips, additional stops, or add-on services.
     

  • Charges for optional add-ons (e.g., refundable booking upgrade) are non-refundable.
     

4.4 Repair, Cleaning, and Pet Fees:

  • Users are responsible for vehicle damage beyond normal wear and tear.
     

  • Fees for cleaning or pet travel may apply.
     

4.5 Sales Partner Commission:

  • Commission percentages may change.
     

  • Only completed trips qualify for commission.
     

  • Minimum withdrawal is ₹2,000, with PAN verification required.
     

 

5. Disclaimers and Limitations of Liability

5.1 Disclaimer:

  • Services are provided “as is” and “as available.”
     

  • KabJunction does not guarantee uninterrupted, error-free service or the quality of third-party providers.
     

5.2 Limitation of Liability:

  • KabJunction is not liable for direct, indirect, incidental, or consequential damages, including loss of profit or property, delays, cancellations, or disputes with third-party providers.
     

  • Maximum liability is ₹500.
     

5.3 Indemnity:

  • You agree to indemnify KabJunction and its affiliates against claims arising from your use of the Services, breach of Terms, or violation of third-party rights.
     

 

6. Governing Law & Dispute Resolution

  • These Terms are governed by Indian law.
     

  • Parties shall attempt to resolve disputes amicably for 30 days.
     

  • Unresolved disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996.
     

  • Venue: New Delhi, India.
     

  • Exclusive jurisdiction: Tis Hazari Courts, New Delhi.

7.1 Copyright Claims:

  • KabJunction may send notices via email, SMS, or physical mail.
     

  • You may send notices to KabJunction at: 2033, Fourth Floor, Sainik Colony, Faridabad -121001.
     

7.3 General:

  • You may not transfer these Terms without KabJunction’s consent.
     

  • KabJunction may assign or transfer the Terms to affiliates, successors, or acquirers.
     

  • No joint venture, partnership, employment, or agency relationship is created.
